Mudimah Bernard Case Information
Name: Mr. Mudimah Bernard
Birthdate: April 4, 1964
Nationality: Zambian
Convicted: Murder - March 4, 2005
Sentence: Death Penalty (no lawyer except government legal head, no appeal completed due to lack of representation). Mr. Bernard maintains his innocence (his story is set forth below). The conditions in the Kabwe Prison are extremely difficult.

Appeal Number: 28/2005, the file/record of the case is at the High Court in Lusaka, Zambia.
Family Status: Mr. Bernard has four children born between 1992 and 2001. At this time, one of his daughters is staying with a friend of his deceased wife's. Mr. Bernard received a visit from his daughter earlier this year. He has not heard about his sons in at least 2 years. They were not placed in a home or orphanage so he has no way of knowing where they are at this present time. Mr. Bernard is very concerned about their situation and is still their legal parent. His wife is deceased. Mr. Bernard has not received visits/support from other family members or friends because they are very poor. He does not have any in-country support apart from a prison chaplain, Pastor Kwacha Mvula.
Case: In April, 2001, Mr. Bernard and his wife went to a school regarding their daughter, Fungai. After talking to the teacher, they were told to bring their child urgently to the school, within one hour. Mr. Bernard went quickly out to find a car for transportation. As he was speaking with the driver of a car about a possible ride, a police officer apprehended him. The police officer told him that the car was stolen and that its owner Ahmed Mogra, had been murdered. The date of the murder had been April 10, 2001. The driver of the car accused Mr. Bernard of the crime. Mr. Bernard had never before met the driver. Mr. Bernard was taken into police custody. He was very poor and unable to afford a lawyer. A government lawyer was appointed to represent him. Mr. Bernard says that witnesses testified on his behalf, and that the witness against him was the car driver. His wife died the day that Mr. Bernard was found guilty of murder on March 4, 2005 (Mr. Bernard says that she died of shock and sorrow). Not long after his wife's death, Mr. Bernard's mother died.
Appeal for Support Mr. Bernard would greatly appreciate letters of encouragement, personal care items such as soap, food or money to purchase food, Bibles to share with other inmates and money for assistance with his appeal.

I greet you in the wonderful name of our Lord Jesus Christ. Am fine. My name is Pastor Kwacha Mvula Zambia Prison Fellowship Coordinator Lusaka Care Group. Am a Pastor for a Pentecost Holiness Church. At the same time a voluntary worker I really have a heart for prisoners. I visit different prisons everyday. It has become of my everyday life. Most of the inmates know, I help them access their families, help them source for clothes, courts, medicine etc. Also help with second hand or new bibles, gospel tracts and just in anyway that I can manage to help. Most of them when they come out of prison have no where to go. Therefore I have found a piece of which am intending to build a dropping centre for inmates. Then if that is done, we hope to do alot of activities to keep the ex-prisoners and their families to keep busy in different activities like bricklaying, tailoring, mechanics, electrical, gardening and many other jobs, we are asking for your prayers and your financial or material support in this regard. Your are free to come and visit us so that you can witness this progress.
